Checks and Balances
The legitimization of the Constitution gave us a means, or procedural rules, for statute creation and application. The Constitution also set the rules for the federal government requiring the federal government to act only if the constitution provides them the ability to do so. It was through compromise that the founding fathers would create a constitution to govern the Untied States of America, which produced a system of checks and balances. The founding fathers felt these checks and balances would prevent a concentration of power from occurring.
At no other point, through amendments or original text, do the drafters further define the power of the judiciary or judicial appointment.
